§ General Terms and Conditions of GDPR-Map

§1 General Provisions
1. A user account is required to use the services of GDPR-Map.
2. You must be at least 18 years old to use the services of GDPR-Map.
3. Registering to use the services of GDPR-Map implies agreement to these terms.
4. Users of the service agree to adhere to our published usage restrictions.
5. We reserve the right to modify the service or its various features at any time.
6. Your use of the service does not imply any form of partnership or joint venture.
7. Both free and paid services of GDPR-Map are based on a credit system. These credits are used to limit and track usage. Your plan includes a set number of credits per month corresponding to your billing cycle. The credits within your set allowance are charged at the usual rate each month. Requests exceeding your monthly credit allocation will be billed according to the following table:

§2 Legal Provisions
1. GDPR-Map is a trademark of STDOUT UG.
2. STDOUT UG is a German company. You agree to comply with German jurisdiction when using this service. Furthermore, you commit to not using the service for illegal activities or in any manner that violates these terms.

§3 Warranties
1. All data provided by the service is on an “as is” basis. We make no warranties or representations regarding the accuracy or usability of the data.
2. By using the service, you agree that STDOUT UG is in no way liable for any consequences arising from the use of the information provided by the service.
3. Liability for damages is limited. The obligation to pay damages is limited to the amount of an annual contract fee.

§4 Data Usage Licenses
1. The use of the service implies agreement to respect and comply with the data usage license terms of the returned results, particularly the ODbL license of OpenStreetMap. Users of the service are responsible for complying with the data license terms.
2. Copyright notices and other identifiers on the use of hosted map tiles must not be altered or removed. The customer will indicate on their website the ownership rights of GDPR-Map and OpenStreetMap contributors. If they use the styles provided by GDPR-Map, they agree to indicate the ownership rights of OpenMapTiles.org. 4. The user is not entitled to grant sublicenses unless this is agreed in writing.

§5 Usage
1. GDPR-Map is authorized to perform maintenance work on servers and databases to minimize disruptions in data retrieval.
2. Commercial use is only permitted with the Basic, Pro, and Super Pro packages.
3. Free, non-commercial use is limited to up to 200,000 credits per month. If this limit is exceeded, GDPR-Map may offer the user paid usage options or block the free usage.
4. The user is obliged to keep their login details confidential and protect them from unauthorized use.
5. The display of Static Map Tiles data is only permitted on publicly accessible websites.

§6 Termination
1. Customers may terminate their account at any time for any reason. Termination does not entitle customers to a refund of fees already paid.
2. We may delete any account that we consider to be inactive.
3. We are not obligated to continue the service for accounts on our free trial tier.
4. Unless explicitly agreed upon in writing: We reserve the right to terminate the service for customers at any time. We will refund a pro-rated amount for the remaining period of the current billing cycle.2. We may delete any account that we consider to be inactive.

§8 Abuse
We reserve the right to terminate the account of any user whom we, at our sole discretion, deem to be abusing our service.

We may change our fees at any time by publishing a new fee structure. Existing customers will continue to pay the previous fees unless explicitly agreed otherwise with the customer.
